Terms and Conditions for Webinars / Virtual Training Events

1. Introduction

1.1 These terms apply to webinars, live virtual courses, and virtual training events provided by Prescription Training Company Ltd, trading as The Medication Training Company Ltd (“The Medication Training Company”, “we”, “us”, or “our”).

1.2 These terms form the agreement between us and the client, purchaser, organisation, or delegate in respect of webinars and virtual training events.

1.3 No variation shall be effective unless such variation is agreed in writing by us.

1.4 Verbal agreements will not form part of these terms.

1.5 All prices are quoted exclusive of value added tax, which will be added at the rate applicable on the date the invoice is issued.

1.6 Full payment for open webinar places is due in advance of the course date, unless otherwise agreed in writing.

1.7 For new customers, full payment is due in advance of the course date.

1.8 Where payment terms have been agreed, invoices are payable within 30 days of the invoice date.

1.9 After 30 days from the invoice date, we reserve the right to charge an administration fee of £50 and then interest at 8% above the Bank of England base rate, compounded monthly.

1.10 We may update, amend, replace, or withdraw webinar content where needed to maintain accuracy, safety, quality, or compliance with legal, regulatory, or professional requirements.

2. Webinar Access and Joining Instructions

2.1 Joining instructions will be sent to the client, delegate, or booking contact before the webinar.

2.2 It is the responsibility of the client, delegate, or booking contact to ensure that the correct email address has been provided.

2.3 It is the responsibility of the client, delegate, or booking contact to ensure that joining instructions are received and shared with the correct delegate before the webinar begins.

2.4 Each booked place is for one named delegate only, unless otherwise agreed by us in writing.

2.5 Webinar links must not be shared with unregistered delegates.

2.6 Unregistered delegates may be refused entry or removed from the webinar.

3. Attendance, Participation and Certification

3.1 Delegates must attend the whole webinar or virtual training event to qualify for certification.

3.2 Delegates who join late, leave early, are absent for part of the session, or do not participate sufficiently may not receive a certificate.

3.3 Delegates who join more than 30 minutes late may only be admitted at the trainer’s discretion.

3.4 Admission to the webinar does not guarantee certification if the delegate has missed essential parts of the training.

3.5 Delegates may be required to keep their camera on, answer questions, complete activities, take part in discussions, or otherwise demonstrate participation and understanding.

3.6 Certification is not guaranteed by attendance alone.

3.7 If a delegate is repeatedly interrupted, distracted, unavailable, off-camera without agreement, taking calls, carrying out other work, or otherwise unable to participate fully, the trainer may decide that the delegate has not completed the course to the required standard.

3.8 Where the trainer decides that a delegate has not completed the course to the required standard, we may decline to issue a certificate.

4. Learning Environment and Delegate Preparation

4.1 Delegates must attend from a suitable, quiet environment where they can concentrate and participate without avoidable interruptions.

4.2 Delegates should have protected time for the full duration of the webinar.

4.3 Delegates should not take phone calls, carry out work duties, provide care, or undertake other activities during the webinar.

4.4 Delegates are responsible for ensuring that they have suitable equipment, internet connection, audio, camera access where required, and any necessary software to attend and participate in the webinar.

4.5 We are not responsible where a delegate cannot attend or participate because of issues with their own internet connection, device, software, email access, firewall settings, employer IT restrictions, or other local technical problems.

4.6 Delegates should contact us promptly if they have difficulty accessing a webinar, so that reasonable support can be provided where possible.

5. Courses with Additional Requirements

5.1 Some webinars or virtual training events may include additional requirements such as pre-course learning, pre-course assessments, post-course modules, practical activities, observations, or other required course elements.

5.2 Where additional requirements apply, delegates must complete all required elements to the required standard before certification is issued.

5.3 Where a course is delivered over more than one webinar session, delegates must attend all required sessions in full unless otherwise agreed by us in writing.

5.4 Attendance at only part of a multi-session course may mean that certification is not issued.

6. Assessing Staff Competence to Administer Medicines Course

6.1 Delegates attending the Assessing Staff Competence to Administer Medicines course must complete all required elements of the course.

6.2 Required elements may include pre-course learning or assessment, both webinar sessions, participation activities, and any final online module or assessment required for certification.

6.3 Delegates must be prepared to fully participate in the interactive activities during the course.

6.4 If, in the trainer’s professional judgement, a delegate has not suitably demonstrated the required skills, knowledge, participation, or competence during the webinar sessions, we may withhold access to the final online module and/or decline to issue certification.

6.5 Where certification is not issued for this reason, the course fee remains payable and no refund will be due.

6.6 At our discretion, the delegate may be offered the opportunity to attend a further webinar session or course for reassessment.

7. Conduct, Recording and Course Materials

7.1 Delegates must behave appropriately and must not disrupt the webinar or virtual training event.

7.2 The trainer may remove any delegate whose behaviour is disruptive, inappropriate, abusive, or prevents the effective delivery of the course.

7.3 Where a delegate is removed because of their behaviour, no refund will be due.

7.4 Webinars and virtual training events must not be recorded, copied, photographed, screenshotted, distributed, or shared without our prior written permission.

7.5 Any course materials provided are for the delegate’s own training use only.

7.6 Course materials must not be copied, shared, adapted, uploaded, distributed, sold, or used to train others without our prior written permission.

7.7 All webinar content, slides, trainer explanations, activities, discussions, resources, and supporting materials remain our intellectual property unless otherwise agreed in writing.

8. Cancellations, Transfers and Non-Attendance

8.1 Open webinar bookings cannot be cancelled or transferred within 7 days of the course start date.

8.2 If a client or delegate needs to change an open webinar booking within 7 days of the course start date, a new place must be booked at the full applicable price.

8.3 If a delegate does not attend a booked webinar or virtual training event, no refund will be due.

8.4 If a delegate is unable to attend or participate because of technical issues on their side, this will be treated as non-attendance and no refund will be due.

8.5 For private or commissioned webinars or virtual training events, courses may be changed or cancelled without penalty provided at least 21 working days’ notice is given.

8.6 The following charges will apply for cancellations or changes to private or commissioned webinars or virtual training events made with less notice:

8.6.1 Less than 21 working days’ notice: 25% of the course fee.

8.6.2 Between 14 and 7 working days’ notice: 50% of the course fee.

8.6.3 Less than 7 working days’ notice: 100% of the course fee.

8.7 In the event of non-attendance by our trainer for any reason outside of the client’s control, a refund of the course fee will be issued, or an alternative course date may be offered.

9. Liability

9.1 We will provide webinars and virtual training events using reasonable care and skill.

9.2 We shall not be liable for loss of profit or any indirect, special, or consequential loss arising from the provision or use of the webinar or virtual training event.

9.3 Our total liability shall not exceed the amount paid for the relevant webinar or virtual training event, except where liability cannot legally be limited, including death or personal injury caused by negligence.

9.4 We shall not be liable for delay or failure to perform our obligations where this is due to circumstances beyond our reasonable control.

9.5 Where we use third-party platforms, software, or services to deliver webinars or virtual training events, we are not responsible for failures, outages, restrictions, or technical issues caused by those third-party services.

10. General Terms

10.1 The client may terminate the contract at any time by giving not less than one month’s written notice to us.

10.2 Either party may, without limiting any other remedy, terminate the contract by giving written notice to the other if the other party commits any breach of these terms and, if capable of remedy, fails to remedy the breach within 30 days after being required by written notice to do so.

10.3 Either party may also terminate the contract if the other party goes into liquidation, becomes bankrupt, makes a voluntary arrangement with its creditors, or has a receiver or administrator appointed.

10.4 A notice required or permitted to be given by either party to the other under these terms shall be in writing and addressed to the other party at its registered office, principal place of business, or such other address as may have been notified to the party giving the notice.

10.5 No failure or delay by either party in exercising any of its rights under these terms shall be deemed to be a waiver of that right.

10.6 No waiver by either party of any breach of these terms by the other shall be considered a waiver of any subsequent breach of the same or any other provision.

10.7 English law shall apply to these terms, and the parties agree to submit to the non-exclusive jurisdiction of the English courts.

10.8 Nothing in these terms is intended to, nor shall it, confer any right on a third party, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
