Terms and Conditions

The Medication Training Company Ltd

1. Introduction

  • 1.1 These terms for training courses are the entire agreement between The Medication Training Company Ltd and the client in respect of training courses. No variation shall be effective unless such variation is in writing and signed by The Medication Training Company Ltd and the client. Verbal agreements will not form part of these terms. These terms override any other terms stipulated or referred to by The Medication Training Company Ltd or the client.
  • 1.2 All prices stated at the time of booking are quoted exclusive of value added tax which will be added at the rate applicable on the date the invoice is issued. The PCMA workshops half day or full day will run for a minimum of 10 delegates up to a maximum of 16 delegates. The Assessors full day course will run for a minimum of 10 delegates up to a maximum of 12 delegates. The Emergency Rescue Course will run for a maximum of 12 delegates minimum of 10 delegates. If fewer than 10 delegates attend the course, the charge will be based on 10 delegates attending. Please note if more than the maximum number of delegates arrive for a course our trainer reserves the right to turn away additional delegates. If more than four extra people arrive for a course they will only be accepted at the discretion of the trainer. The extra 1-4 delegates will be charged at £65 per person (ex VAT). We cannot run courses with over 4 extras (20 for PCMA and Assessors and 16 for Epilepsy) these extras over 4 will be turned away.
  • 1.3 The Medication Training Company Ltd shall be entitled to vary its standard charges from time to time unless it gives the client not less than three months’ written notice
  • 1.4 Full payment for open courses is due in advance of the agreed course date.
  • 1.5 For new customers, full payment for courses is due in advance of the agreed course date.
  • 1.6 Payment terms are 30 days after the “invoice date” printed on the invoice. After 30 days from this date, the Medication Training Company Ltd reserves the right to charge an administration fee of £50 and then 8% (over the Bank of England base rate) interest compounded monthly.
  • 1.7 The Medication Training Company Ltd agree to deliver Training Courses in a professional manner using every care to accomplish a satisfactory service and shall at its own expense supply the client with necessary documents or other materials and all necessary data relating to the training course in accordance with these terms. The Medication Training Company Ltd shall ensure the accuracy of all materials it provides.
  • 1.8 The Medication Training Company Ltd may at any time without notifying the Client make any changes to the training courses which are necessary to comply with any applicable safety or other statutory requirements.
  • 1.9 The client must advise The Medication Training Company Ltd in writing or email if it requires any amendments to a confirmed training course.

 

2. Face-to-face (in person), and live virtual courses

  • 2.1 Delegates must attend the whole of the Training Courses to qualify for certification. Attendees who are more than 30 minutes late may only be admitted a course at the discretion of trainer.
  • 2.2 In the event that no delegates attend a confirmed training course, the trainer will wait at the training venue for one hour or until instructed to leave by the client, and the client will pay the Medication Training Company Ltd the full agreed price for the Training Course – based on the minimum charge for 10 attendees.
  • 2.3 If the trainer has to travel more than 2 hours, we will charge £105 per night towards the cost of the accommodation. If the venue is more than 25 miles away from the trainer’s home address, we will charge the number of miles in excess of 25 miles @ 50p per mile or the cost for using public transport e.g., the venue is 100 miles away one way you will pay for 150 miles @ 50p per mile. If public transport is used, then full receipts will be provided to the client on request.
  • 2.4 Training courses may be changed or cancelled without penalty providing at least 21 working days’ notice is given. An administration fee of 25% of a Training Course fee will be incurred for cancellations or changes of less than 21 working days’ notice, 50% between 14 and 7 working days’ notice, and 100% if less than 7 working days’ notice is given to The Medication Training Company Ltd.
  • 2.4.1 Virtual open course bookings cannot be canceled or transferred within 7 days of the course start date. If you need to change your booking within this period, you will be required to book a new place at full price.
  • 2.5 The Medication Training Company Ltd shall provide all training delegates with handouts for all courses, including any supporting material required to save as otherwise agreed between The Medication Training Company Ltd and the client.
  • 2.6 The Client will provide and pay for the venue for the training course unless otherwise agreed in writing. The client shall ensure that the venue is suitable for The Medication Training Company Ltd.’s requirements and is clean and tidy and ensures the health and safety of the trainer and attendees. The client will provide sufficient chairs and tables for the delegates. The Client will be liable for any insurance required for this venue and will provide a copy of the insurance certificate to The Medication Training Company Ltd if requested. If the room is not suitably laid out, we reserve the right to cancel the training.
  • 2.7 In the event of non-attendance by The Medication Training Company Ltd.’s trainer for any reason outside of the client’s control, a refund of the course fee will be issued.
  • 2.8 Where The Medication Training Company Ltd are responsible for paying for room hire and/or refreshments, a reasonable cost will be added to reflect the costs incurred by The Medication Training Company Ltd
  • 2.9 Assessing staff competency to administer medicines courses – Attendees should be prepared to fully participate in the interactive activities during the ‘Assessing staff competency to administer medicines’ workshops. Should the trainer feel individual delegates have not suitably demonstrated the skills and knowledge required during the webinars or in-person courses, enrolment in the final online module of the course for assessor certification will not be permitted. Courses are non-refundable in these instances although delegates may be allowed to attend the webinar once more for re-assessment by the trainer.
  • 2.9.1 For virtual courses you will need a computer, laptop, or tablet with a stable internet connection, speaker, microphone, and webcam. We are not responsible for technical issues beyond our control, such as internet outages or hardware malfunctions. By enrolling in our virtual courses, you agree to be responsible for meeting the stated technical requirements.
    Failure to meet the technical requirements may affect your ability to participate fully in the course.

 

3. Online course vouchers

  • 3.1 Vouchers (also known as licenses or voucher codes) are issued via email to either individual learners or to the contact provided by the purchasing organisation (usually the Learning and development lead) once payment is received.
  • 3.2 Once in receipt of voucher codes the purchasing organisation can issue these to their own staff for redemption via the Medication Training Company website.
  • 3.3 Access to the purchased online course is granted when the voucher has been successfully redeemed and allocated to a registered user.
  • 3.4 On completion of any course, certificate awardees will retain access to the course for the duration of their certificate validity, or in the instance of lifelong validity (non-expiring) certificates, 1 year. After which time access will be de-activated. It is the responsibility of the individual learner, or the purchasing organisation, to keep a copy of the awarded certificate for their records.
  • 3.5 Where single, bulk, or multiple purchases are made, vouchers are not transferable between Medication Training Company courses
  • 3.6 Vouchers are non-refundable. Redeemed vouchers (courses) may be re-assigned to an alternative user by request of the purchasing organisation for a small administration fee at the discretion of the Medication Training Company, providing no part of the course assessments (also known as quizzes) have been accessed or attempted by the original user. Please contact info@medicationtraining.co.uk for current voucher re-assignment administration charges.
  • 3.7 The Medication Training Company regularly reviews and updates online course content to maintain currency and accuracy of information. If you hold unredeemed vouchers for a course that has been superseded or is no longer available, your voucher will be transferred to the most appropriate alternative at the discretion of The Medication Training Company.

 

4. Liabilities

  • 4.1 The property and any copyright or other intellectual property rights in any material provided by The Medication Training Company Ltd shall, unless otherwise agreed in writing between the client and The Medication Training Company Ltd, belong to The Medication Training Company Ltd, subject only to the right of the client to use the material for the purposes of utilising the Training Courses.
  • 4.2 The Medication Training Company Ltd warrants to the client that the Training Courses will be provided using reasonable care and skill and, as far as reasonably possible, in accordance with the specification. Where The Medication Training Company Ltd supplies, in connection with the provision of the Training Courses, any goods supplied by a third party, The Medication Training Company Ltd does not give any warranty, guarantee or other term as to their quality, fitness for purpose or otherwise, but shall, where possible, assign to the Client the benefit of any warranty, guarantee or indemnity given by the person supplying the goods to The Medication Training Company Ltd.
  • 4.3 Except in respect of death or personal injury caused by The Medication Training Company Ltd.’s negligence or as expressly provided in the Terms, The Medication Training Company Ltd shall not be liable to the client by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under these terms, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of The Medication Training Company Ltd, its trainees or agents or otherwise) which arise out of or in connection with the provision of the Training Courses or their use by the Client, and in any event the entire liability of The Medication Training Company Ltd under or in connection with these terms shall not exceed the amount of The Medication Training Company Ltd.’s charges for the provision of the Training Courses, except as expressly provided in these terms.
  • 4.4 The Medication Training Company Ltd shall not be liable to the client or be deemed to be in breach of these terms by reason of any delay in performing, or ay failure to perform, any of The Medication Training Company Ltd.’s obligations in relation to the Training Courses, if the delay or failure was due to any cause beyond The Medication Training Company Ltd.’s reasonable control.
  • 4.5 The client may terminate the contract at any time by giving not less than one month’s written notice to The Medication Training Company Ltd.
  • 4.6 Either party may (without limiting any other remedy) at any time terminate the contract by giving written notice to the other if the other commits any breach of these terms and (if capable of remedy) fails to remedy the breach within 30 days after being required by written notice to do so, or if the other goes into liquidation, becomes bankrupt, makes a voluntary arrangement with its creditors, or has a receiver or administrator appointed.
  • 4.7 A notice required or permitted to be given by either party to the other under these terms shall be in writing addressed to the other party at its registered office or principal place of business or such other address as may at the relevant time have been notified pursuant to this provision to the party giving the notice.
  • 4.8 No failure or delay by either party in exercising any of its rights under these terms shall be deemed to be a waiver of that right, and no waiver by either party of any breach of these terms by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.
  • 4.9 English Law shall apply to these terms, and the parties agree to submit to the non-exclusive jurisdiction of the English Courts.
  • 4.10 Nothing in these terms is intended to, nor shall it, confer any right on a third party whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
